In a significant observation on administrative governance, the Jammu and Kashmir Public Service Commission (JKPSC) has raised serious alarms over the prevailing recruitment framework in the Union Territory. Terming the current rules “obsolete” and “redundant,” the UT’s premier recruitment body has recommended an immediate, comprehensive revision across all government departments to meet modern administrative demands and stem recurring legal disputes.
The concerns and recommendations were officially highlighted in the Commission’s Annual Report for 2025–26.
Decades-Old Framework Unfit for Modern Administration
The Commission noted with grave concern that service regulations in several departments have remained untouched for decades, creating a sharp mismatch between existing qualifications and modern administrative requirements.
“Recruitment Rules of most of the State Government Departments framed decades ago are very old, outdated, obsolete and have become redundant and require their revisions and updating to keep pace with the fast-changing social, economic and technological scenario, as well as efficiency and expertise required for handling assignments of complex nature in view of the diversification and specialization in the field of governance and functioning of government organizations,” the annual report stated.
The Commission specifically emphasized the necessity to accommodate rapid advancements and specializations in critical sectors such as Education, Medical Sciences, and Computer Sciences, asserting that modern service rules must actively incentivize specialized technical knowledge and high-level competence.
Key Observations and Recommendations
- Curbing Unnecessary Litigation: Updating and clarifying recruitment frameworks will directly minimize ambiguities, which remain a primary driver of service-related court disputes and prolonged hiring delays in the UT.
- Flawed Promotion Structures: The Commission flagged a critical anomaly where personnel in certain cadres are elevated to higher posts without possessing essential baseline qualifications. It strongly recommended that minimum educational and technical qualifications be strictly mandated during rule revisions.
- Incomplete Draft Proposals: The PSC pointed out that administrative departments often submit incomplete draft proposals for concurrence, lacking vital documents such as comparative statements, creation/abolition orders, and Finance Department clearances for post reclassifications.
- Standardized Checklist Issued: To ensure administrative uniformity and expedite approvals, the Commission has distributed a standardized submission checklist to all departments.
- Mandatory Consultation: The Commission cautioned departments against enacting unilateral amendments to service rules without statutory consultation with the PSC.
- Immediate Notification of Cleared Rules: The apex body urged administrative departments to promptly notify all revised recruitment rules that have already received formal PSC concurrence.
